Tsp.exchange ("we," "us," or "our"), this platform is a special platform designed for users to trade in digital assets and to provide related services (hereinafter referred to as "The Service" or "Services"). For the convenience of expression, the platform is jointly referred to as "we" or other first-person names in this Agreement; as long as the natural person or other subjects who land on the platform are users of the platform, the following use "you" or another second person, you and we are collectively known as "both parties," you or we are only called "one-party."

We are committed to protecting your privacy and ensuring the security of your personal information. This policy applies to all of the products and services that we provide. If we have a separate privacy policy for the product or service provided by you, its individual privacy policy shall apply; if our product or service has no different privacy policy, this policy shall apply.

This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you use our platform. By accessing or using our platform, you agree to the terms of this Privacy Policy.

1. Definition

Digital Asset

As used herein,” Digital Asset,” also called “convertible virtual currency,” “cryptocurrency,” or” digital goods,” such as bitcoin or ether, which is based on the cryptographic protocol of a computer network that may be (i) centralized or decentralized, (ii) closed or open-source, and (iii) used as a medium of exchange and; this store of value.

Personal Data

As used herein,” Personal Data” means any information relating to an identified or identifiable natural person, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, economic, cultural or social identity of you as a natural person.

2. What Information We Collect

We collect the following personal information, this includes information you provide to us, information that is gathered about you automatically, and information we obtain from third parties.

2.1 Information You Provide to Us

Individual Customers

  • Email address

  • Mobile phone number

  • Full legal name (including former name and words in local language)

  • Nationality

  • Passport number or any government-issued ID number

  • Date of birth (“DOB”)

  • Proof of identity (e.g., passport, driver’s license, or government-issued ID)

  • Residential address

  • Proof of residency

  • Additional Personal Data or documentation at the discretion of our Compliance Team

Corporate Customers

  • Corporate legal name (including the legal representation in the local language)

  • Incorporation/Registration Information

  • The full legal name of all beneficial owners, directors, and legal representatives

  • Address (principal place of business and other physical locations)

  • Proof of legal existence

  • Description of the business

  • Percentage of ownership for Individual/corporate owners

  • Contact information of owners, principals, and executive management (as applicable)

  • Proof of identity (e.g., passport, driver’s license, or government-issued ID) for significant individual beneficial owner of the institutional customer entity

  • Personal Data for each entity’s important beneficial owner of the institutional customer entity (see the “Individual Customer” section above for details on what Personal Data we collect for individuals)

  • Source of wealth

  • Amount of bitcoin or other digital assets projected to be injected

2.2 Information Collected Automatically

  • Browsing Information: Device ID, browsing information such as name and version, IP address

  • Usage Data: Authentication data, security questions, click-stream data, public social networking posts, and other data collected via cookies or similar technologies.Information about how our Services are performing when you use them, e.g., error messages you receive, performance of the site information.

2.3 Information We Obtain from Affiliates and Third Parties

  • Affiliates: By applicable law, we may obtain information about you from the group of companies related to us by common control or ownership (“Affiliates”) as a regular part of conducting business to offer our Affiliates’ Services. We may obtain information about you, such as Personal Identification, Transactional, Institutional, and Usage Information.

  • Blockchain Data: We may analyze public blockchain data, such as transaction IDs, transaction amounts, wallet addresses, timestamps, or transactions or events.

3. How Do We Share, Transfer, and Publicly Disclose Your Information

3.1 Sharing

We will not share your personal information with companies, organizations, and individuals other than the platform service providers, except where:

  • Sharing under legal circumstances: We may share your personal information by the provisions of laws and regulations, litigation and dispute resolution needs, or according to the requirements of administrative and judicial organs.

  • Share with explicit consent: We will share your personal information after obtaining your unambiguous consent.

  • Share under your active choice: We will share the necessary information related to the transaction with the counterparty of the digital assets according to your preference to realize your transaction and after-sales service needs.

  • Share with Authorized Partners: Our related parties, trusted third parties who help us operate our platform, conduct business, or provide services to you, provided they agree to keep the information confidential; when we believe the information disclosed is appropriate, regulations, or from the law or the rights, property or security of us or others.

3.2 Transfer

We will not transfer your personal information to any company, organization, or individual, except if:

  • Transfer under explicit consent: After obtaining your explicit consent, we will share your personal information with other parties;

  • In case of merger, acquisition, or bankruptcy liquidation on this platform, or other situations involving merger, investment, or bankruptcy liquidation, if personal information transfer is concerned, we will require new companies and organizations that hold your personal information to continue subject to this policy. Otherwise, we will need the company, organizations, and individuals to seek your authorization again.

3.3 Public Disclosure

We will publicly disclose your personal information only if:

  • With your express consent or based on your active choice, we may publicly disclose your data;

  • If we determine that you violate laws and regulations or have severe violations of the relevant agreements and rules of the platform, or to protect the personal and property safety of the platform users or the public from infringement, we may disclose our confidential information about you by laws and regulations or with your consent, including relevant violations and the measures that the platform has taken to you.

3.4 Exceptions to Prior Authorization for Sharing, Transfer, or Public Disclosure of Personal Information

No prior authorized consent is required to share, transfer, or publicly make disclosure of your personal information under:

  • Related to national security and national defense security;

  • About public safety, public health, and significant public interests;

  • Related to judicial or administrative law enforcement such as crime investigation, prosecution, trial, and judgment execution;

  • To protect the primary legitimate rights and interests of your life or other individuals, but it isn't easy to obtain personal consent;

  • The personal information that you will disclose to the public by yourself;

  • Collect personal information from legally publicly disclosed information, such as legal news reports, government information disclosure, and other channels.

Please be aware that, under the applicable law, if we take technical and other necessary measures to process personal information so that the data recipient cannot reidentify specific individuals and cannot recover, the sharing, transfer, and public disclosure of such processed data requires further notice to you and your consent.

4. How Secure is My Information?

We design our systems with your security and privacy in mind. We have appropriate security measures to prevent your information from being accidentally lost, used, or accessed unauthorizedly, altered, or disclosed. We work to protect the security of your personal information during transmission and while stored by using encryption protocols and software. 5. What Rights Do I Have?

Subject to applicable law, as outlined below, you have several rights to privacy and protect your personal information. You can request access to, correct, and delete your personal information and request data portability. You may also object to our processing of your personal information, or we may restrict the processing of your personal information in certain instances. In addition, when you consent to our processing of your data for a specified purpose, you may withdraw your consent at any time.

  • Right to rectify: you can request the rectification of your personal information, which is inaccurate, and also add to it. You can also change your personal information in your Account at any time.

  • Right to delete: you can, in some cases, have your personal information deleted;

  • Right to object: for reasons relating to your particular situation, you can object to processing your personal information. For instance, you have the right to object where we rely on legitimate interest or where we process your data for direct marketing purposes;

  • Right to restrict processing: You have the right, in some instances, to temporarily restrict the processing of your personal information by us, provided there are valid grounds for doing so. We may continue to Account for your personal information if it is necessary for the defense of legal claims or any other exceptions permitted by applicable law;

  • Right to portability: in some cases, you can ask to receive your personal information which you have provided to us in a structured, commonly used, and machine-readable format, or, when this is possible, that we communicate your personal information on your behalf directly to another data controller;

  • Right to withdraw youAccountnt: for processing requiring your consent, you have the right to withdraw your consent at any time. Exercising this right does not affect the lawfulness of the processing based on the consent given before the withdrawal of the latter;

6. Children’s Personal Information

Individual sites and Services are not directed to persons under 18, and we do not knowingly request or collect any information about persons under 18. If you are under 18, please do not provide personal information through the Sites or Services. Suppose a User or Customer submitting personal information is suspected of being younger than 18. In that case, Tsp.exchange will require the relevant Customer or User to close their Account and will take steps to delete the individual’s information as soon as possible.
